US State Department Spokesman Matthew Miller on why the ICC can prosecute Russia but not Israel: “The difference between Russia and Israel is that Israel is a democratic state with accountability mechanisms and investigations that are currently underway there. This is not about Russia. We are not aware of any investigation into war crimes in Russia. There is a fundamental difference: Israel said they would cooperate in the investigation, Russia did not. Israel said that they would interact, talk with the ICC about the charges that they were preparing to bring against them. The ICC terminated this cooperation.
