Dirty Tricks Prosecutor Matthew Weatherman Admits to asking me to Waive a Fundamental Right

A prosecutor shall not seek to obtain from an unrepresented accused a waiver of important pretrial rights, such as the right to a preliminary hearing. I was not represented and he knew it. Prosecutor Matthew Weatherman asked me to wave my fundamental right of a preliminary hearing. This goes against his own rules of professional conduct. (c) not seek to obtain from an unrepresented accused a waiver of important pretrial rights, such as the right to a preliminary hearing Has prosecutor Weatherman violated your civil rights in the past? We’d like to know. Here is the entire phone call RULE 4-3.8: SPECIAL RESPONSIBILITIES OF A PROSECUTOR Accordingly, prosecutors should not seek to obtain waivers of preliminary hearings or other important pretrial rights from unrepresented accused persons. Unheard motion in my case IN THE CIRCUIT COURT OF OZARK COUNTY, MISSOURI STATE OF MISSOURI, Case No. 21OZ-CR00214-03 DARRELL MCCLANAHAN MOTION FOR SPECIAL PROSECUTOR/REQUEST HEARING Comes Now Darrell McClanahan pro se does respectfully request the Honorable Court to recuse/disqualify Ozark County Prosecutor Matt Weatherman. Prosecutor Weatherman should be recused/disqualified due to his conflict of interest concerning his friend and fellow attorney Christopher Swatosh concerning unethical behavior on the part of attorney Christopher Swatosh. Attorney Swatosh on 10/1/21 released political dirt concerning John Russo’s application for Ozark Co. Prosecutor. This information given to me was that John Russo owed $50,000 in back taxes. Christopher Swatosh asked me to release the information on my YouTube channel Missouri Battleflag saying the “public won’t like that” and “there is no way Judge Carter would appoint him; he’s a three time loser” referring to Russo, knowing this personal information would make it impossible for Russo to be appointed to the position of Ozark County Prosecutor. The information was published and released weeks prior to Russo’s withdrawal of his application for Ozark Co. Prosecutor. These circumstances affect Ozark County Prosecutor Matt Weatherman’s ability to prosecute the above case/Darrell McClanahan. A prosecutor should not allow interests in personal advancement or aggrandizement to affect judgement regarding what is in the best interest of justice in any case.  A prosecutor who has significant personal, political, financial, professional, business, property, or other relationship with another lawyer should not participate in the prosecution of a person who is represented by the other lawyer. I believe the allegations and conflict of interest are serious enough to warrant an official investigation.  For these reasons, I request the Honorable Court to schedule a hearing and subpoena Christopher Swatosh to answer to these allegations. I do respectfully request the Honorable Court to recuse/disqualify Prosecutor Matt Weatherman. Darrell McClanahan
